What of the "Torture" Issue in the US?

When does the individual's rights for protection under the United States' Constitution allow the individual to injure others protected by that constitution? And when does the police state have the right, if ever, to take away the individual's rights in order to protect the greater society?

Agree or not, comments by U.S. Supreme Court Justice Antonin Scalia in an interview with the BBC should be considered.

My Take: We spend so much effort protecting individual rights that we sometimes lose sight of expecting individual responsibilities.
